The Initiative establishes laws regarding marijuana dispensaries and caregivers. Caregivers must be designated by the patient and have the responsibility of assisting the qualified patient with the medical use of marijuana. Caregivers must be at least 21 years of age or older. Dispensaries are defined as non-profit collectives authorized to grow and provide registered qualifying patients with usable marijuana and related paraphernalia. These are state licensed operations that must register with the state of Massachusetts. The state limits the number of operational state licensed dispensaries to 35. But, patients can privately cultivate limited amounts of cannabis or designate a primary caregiver to cultivate for them if they are unable to access state authorized dispensaries, or if they can verify financial hardship.
